Terms of Use You agree to these terms when using Global Reporter
1. Your Acceptance By using and/or visiting the Global Reporter website (together with all content available through the Globalreporter.com domain name and other sites owned, operated or controlled by Global Reporter Inc.), or submitting content to the Global reporter website, you expressly agree to the following Terms and Conditions and Privacy Policy herein. By using Global Reporter Inc., you agree to the collection, transfer, storage and use of your personal information on servers located in the United States and in the European Union as further described in our privacy policy.
If you do not agree to the Terms & Conditions and the Privacy Policy herein then you hereby expressly release Global Reporter from any and all liability arising from postings, actions or any behaviours whatsoever that are outside of the Terms & Conditions and the Privacy Policy of Global Reporter. Please refrain from using the Global reporter website unless the Terms & Conditions and the Privacy Policy are agreed to and accepted.
You will post in the appropriate category or area and will not do any of the following bad things: violate any laws or our content copyright policy;
be false or misleading;
infringe any third-party right;
distribute or contain spam, chain letters, or pyramid schemes;
distribute viruses or any other technologies that may harm Global Reporter Inc. or the interests or property of Global Reporter Inc. users;
impose an unreasonable load on our infrastructure or interfere with the proper working of the Global Reporter Inc.;
copy, modify, or distribute any other person’s content;
use any robot, spider, scraper or other automated means to access Global Reporter Inc. and collect content for any purpose without our express written permission;
harvest or otherwise collect information about others, including email addresses, without their consent;
bypass measures used to prevent or restrict access to Global Reporter Inc..
Fees and Services: Using Global Reporter Inc. is generally free. We may charge fees for certain services. If the service you use charges a fee, you’ll be able to review and accept that charge. Our fees are quoted in Canadian Dollars, and we may change them from time to time. We’ll notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service. Our fees are non-refundable, and you are responsible for paying them when they’re due. If you don’t, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).
Some of Global Reporter Inc.’s features may display your ad on other sites that are part of the Global Reporter community of websites. By using Global Reporter Inc., you agree that your ads can be displayed on these other sites. The terms for our other sites are similar to these terms, but you may be subject to additional laws or other restrictions in the countries where your ad is posted. When you choose to post your ad to another site, you may be responsible for ensuring that it does not violate our other site policies. We may remove your ad if it is flagged on any of our sites, or if we believe it causes problems or violates any law or policy.
2. External Websites / Links
The Global Reporter website may contain links to third party websites that are not owned or controlled by Global Reporter.
Global Reporter has and maintains no affiliation of any kind with any third party websites.
Global reporter does not in any way endorse any third party websites;
Global Reporter assumes no responsibility for the content, privacy policies, or practices of any third party websites.
Global Reporter will not and cannot censor or edit the content of any third-party site.
By using the Global Reporter website, you expressly release and indemnify and hold harmless Global Reporter Inc., its officers and directors, employees and agents and/or licensors, its affiliates, and their respective officers, directors, employees and agents and/or licensors from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you have left the Global Reporter website and to read the terms and conditions and privacy policy of each other website that you visit.
3. Website Use and Access
Global Reporter hereby grants you permission to use the Global Reporter website, provided that:
your use of the Global Reporter website is solely for your individual, personal and non-commercial use (i.e.: non-profit);
you will not replicate, copy, distribute or modify any part of the Global Reporter website without Global Reporter’s prior written authorization;
you will not send unsolicited or unauthorized advertisements, spam, chain letters, etc. to other users, advertisers or patrons of Global Reporter,
you will not transmit any content or material which infringes upon the intellectual property rights of a third party;
you will not transmit any Content which contains viruses or other harmful computer codes, files or programs;
you will not disrupt servers or networks connected to the Global Reporter website; and
you will comply with all of the Terms & Conditions herein.
In order to access certain features of the Global Reporter website, creation of a user account will be required. Use of another User’s account is strictly prohibited without written authorization from both that User and Global Reporter. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account and hereby indemnify and hold harmless Global Reporter Inc., its officers and directors, employees and agents and/or licensors, its affiliates, and their respective officers, directors, employees and agents and/or licensors from any and all liability arising from unauthorized use of your account. You must notify Global Reporter immediately of any unauthorized use of your account. You will be liable for any use made of your account or password and the losses of Global Reporter or others due to such unauthorized use. Global Reporter will not be liable for your losses caused by any unauthorized use of your account and is indemnified absolutely by you from same.
You agree not to use or launch any automated system (including without limitation, “robots,” “spiders,” and “off-line readers”) that accesses the Global Reporter website in a manner that sends more request messages to the Global Reporter servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Global Reporter grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Global Reporter reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names or e-mail addresses, from the Website, nor to use the communication systems provided by the Website for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions (as defined below).
You agree that your use as a User does not violate any applicable laws, rules or regulations in which the user’s submissions could be viewed or otherwise accessed and used.
Global Reporter has the right to terminate your User Account and/or access to the Global Reporter website, in its sole discretion, immediately and without prior notice, with or without cause.
4. Intellectual Property Rights
The content on the Global Reporter website, including all User Submissions, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos and interactive features (hereinafter “Content”) and the trademarks, service marks, copyrights and logos contained therein (hereinafter “Marks”), are owned by or licensed to Global Reporter. Content on the Website is provided to you as is for your information and personal use only and may not be used, replicated, copied, distributed, transmitted, broadcast, displayed, sold, licensed, reverse engineered, de-compiled, or otherwise exploited for any other purposes whatsoever without Global Reporter’s prior written consent. Global Reporter reserves all rights not expressly granted in and to the Global Reporter website. If you download or print a copy of the any Content for personal use, you must retain all copyright and other proprietary notices contained therein.
You further agree not to circumvent, disable or otherwise interfere with security-related features of the Global Reporter website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Global Reporter website.
5. User Submissions
The Website facilitates the submission of text, videos or other Content by you and other users (hereinafter “User Submissions”) and the hosting and publishing of such User Submissions. You understand that whether or not such User Submissions are published, Global Reporter does not guarantee any confidentiality with respect to any User Submissions. Global Reporter has the complete and unilateral discretion whether to accept or reject your User Submission, or to transfer your User Submission from one Global Reporter program to another program or portion of the Global Reporter website.
You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them and fully indemnify and hold harmless Global Reporter Inc., its officers and directors, employees and agents and/or licensors, its affiliates, and their respective officers, directors, employees and agents and/or licensors from any and all liability resulting from same. You hereby represent and warrant that:
you own or have the necessary rights and permissions to use and authorize Global Reporter to use all copyright, trademark or other proprietary rights in and connected to any of your User Submissions to enable inclusion and use thereof as contemplated by the Global Reporter website and these Terms & Conditions; and
you have the written consent and/or express permission of each and every identifiable individual person in the User Submission to use their name or likeness as contemplated by the Global Reporter website and these Terms & Conditions.
You retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to Global Reporter, you hereby grant Global Reporter a worldwide, non-exclusive and transferable license to use, copy, prepare derivative works of (including without limitation, to rename, edit, shorten, split the videos into different segments, and use the entire video or segments as part of compilations), display, and perform the User Submissions in connection with the Global Reporter website and Global Reporter’s (and its successor’s) business, including without limitation to grant access to the Website to third parties to view the User Submission (and derivative works thereof).
You also hereby grant each user of the Global Reporter website or other viewer of the User Submission a non-exclusive right to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions, all for non-commercial and personal use.
You hereby acknowledge and agree that Global Reporter does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Global Reporter expressly disclaims any and all liability in connection with said User Submissions.
You expressly agree that you will not:
submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the User Submission and to grant Global Reporter all of the license rights granted herein;
publish falsehoods or misrepresentations that could damage Global Reporter or any third party;
submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; and
intentionally or inadvertently misidentify yourself in submitting the User Submission or misstate your true identity.
You understand that when using the Global Reporter website, you will be exposed to User Submissions from a variety of sources, and that Global Reporter is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against Global Reporter Inc. with respect thereto, and agree to indemnify and hold harmless Global Reporter Inc., its officers and directors, employees and agents and/or licensors, its affiliates, and their respective officers, directors, employees and agents and/or licensors, to the fullest extent allowed by law regarding all matters related to your use of the Website.
You acknowledge that access to certain Content which may be available through the Global Reporter website and which depict violence, or contain images of nudity, sexual acts, or other sexual material (“Mature Content”) is permitted only if you are over the minimum age applicable in your jurisdiction (often but not necessarily 18 or 21).
Submission Rules and Guidelines
Replication Please refrain from duplicating videos that already exist on the site. Prior to uploading a video to Global Reporter, please conduct a diligent search to see if it has already been posted by another User.
Sexual Content: Global Reporter does not allow sexually explicit videos on this site.
Violence: Please filter video clips and news stories containing violence as mature and/or that it has an 18+ years of age requirement to view. PLEASE NOTE: Global Reporter will reject videos which portray illegal acts of violence or videos that show or imply human fatalities however newsworthy such footage may be permitted by Global Reporter in certain contexts and postings.
Categories. Please place your videos and stories in the appropriate category. If you feel a new category should be available and/or created please send us your category suggestions at: legal@globalreporter.ca.
6. Copyright and Content Policy
Global Reporter respects the intellectual property rights of others, and requests you to do the same. Global Reporter does not permit copyright infringing activities and infringement of intellectual property rights on its Website.
Global Reporter will remove all Content if properly notified that such Content infringes on another’s intellectual property rights.
Global Reporter reserves the right to remove Content without prior notice. Global Reporter will also terminate a User’s access to the Global Reporter website, if they are determined to be in violation of the terms herein. Global Reporter may remove such Content and/or terminate a User’s access for uploading such Content in violation of these Terms & Conditions at any time, without prior notice and at its sole discretion.
If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide Global Reporter’s Legal Affairs Department the following information:
an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright;
a description of the copyrighted work that you claim has been infringed, including the URL (web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
a description of where the material that you claim is infringing is located on the Global Reporter website, including the URL;
your address, telephone number, and email address;
a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

7. Warranty Disclaimer
YOU AGREE THAT YOUR USE OF THE GLOBAL REPORTER WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, GLOBAL REPORTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. GLOBAL REPORTER MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE WEBSITE’S CONTENT AND ASSUMES NO LIABILITY FOR ANY (I) MISTAKES OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT ON OR VIA THE WEBSITE. 8. Limitation of Liability
IN NO EVENT SHALL GLOBAL REPORTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) CONTENT, INCLUDING ANY MISTAKES OR INACCURACIES THEREIN, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT ON OR VIA THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GLOBAL REPORTER IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE THAT GLOBAL REPORTER SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
As most of the content on Global Reporter Inc. comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Global Reporter Inc., even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
9. Indemnity
You agree to indemnify and hold harmless Global Reporter Inc., its officers and directors, employees and agents and/or licensors, its affiliates, and their respective officers, directors, employees and agents and/or licensors, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) arising from:
your use of the Website;
your violation of these Terms & Conditions;
your violation of the terms which apply to your User Submission;
your violation of any third party right, including without limitation any copyright, property, publicity or privacy right; or
any claim that one of your User Submissions caused damage to a third party.
This defense and indemnification obligation will survive these Terms & Conditions and your use of the Global reporter website.
Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.
10. Ability to Accept Terms & Conditions
You affirm that you are either more than 18 years of age or possess legal parental or guardian consent to enter into these Terms & Conditions, and to comply with these Terms of Use.
11. Assignment
These Terms & Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Global Reporter without limitation and/or restriction.
